DIRECT EXAMINATION BY MR. LEONARD:
Q.Okay.Now, I want to direct your attention to the morning of June 13, 1994.
First of all, where had you been the night before, that was the night of
A.I was out at the movies.
Q.What time did you return home approximately?
A.I had to have returned home around 12:30; between 12 and 12:30.
Q.Okay. Now, at some point early in the morning on the 13th, was there
a knock at your door --
Q.-- where you were staying? Show the jury where your room was, where
you were staying that night?
A.Right here (indicating to Exhibit 116.)
Q.Now, describe to the jury what happened after you heard the knock on
A.Two men knocked on my door. I opened the door. They asked me who I was.
I told them who I was. *They asked me where my father was and I told
them that I didn't know where he was but I knew somebody that could get
in touch with him. At that point, I put my clothes on to go into the house.

Q.At that point, did the police -- do you recall which -- we've had several
police detectives testify here. Do you recall which ones, right now, came
to your door and spoke to you?
A.Vannatter and Lange
Q.Okay. Was there another police officer that you saw at some point up on
A.Yes, there's two more police officers that I saw that day.
Q. Okay. Now, they came to your door, they knocked on your door, they asked
you where your father was, right?
Q.At that point, did they ask you any other questions, such as did you hear
any strange noises, did you see anything unusual or are there any people
that are injured on the property, anything like that?
Q.Just asked you if you knew where your father was?
Q.Now, you put your clothes on, and the officers accompanied you back
into the house; is that right?
Q.(BY MR. LEONARD) What did you do next?
A.They followed me into the house and -- I left my room to go into the
Q.Show us the route you took?
A. I left my room to go into the house going this way.
A. And I went around and went to the front door.
Q. Okay. Now, you've -- what you've described is going around the north
side of the house, correct?
A. Yes, going through here, the backyard.
Q. You're going by the pool in a northerly direction?
A. Yes. And going on the side of the house.
Q. The north side of the house along that path --
Q. -- that runs in between the house and Ashford Street, correct?
A. Correct. And then this way.
Q. Okay. Now, why did you go that way?
A. Because I had to go inside the house.
Arnelle lies. Yes that is the way Arnelle did go from her room to her father's front door, earlier before the police arrived. But that is not the way she went when the police first awakened her, asked her about her father, and followed her into the house.
Q.Okay. Now, three detectives have testified before this jury that you
went right in -- there's a back door right here?
A.Yeah, there's a door right here.
Q.They testified that you had your keys out and you had to open up a
lock with the keys and you went in that way. Did you do that night?
A. No. It's impossible.
Q. (BY MR. LEONARD) Did you go in the back door?
A. No, I did not.
Arnelle lies. Arnelle is correct that it would have been impossible for her to have unlocked the back door with a key.It could only be locked or unlocked from the inside. Lange and Vannatter testified that they saw Arnelle with her keys, and she unlocked the back door. They were mistaken.
Q.(BY MR. LEONARD) I ask you to take a look at those two photographs,
Ms. Simpson. I'm going to ask you if they accurately depict the back door
that we've just been talking about as it existed on June 12 -- excuse me
-- the morning of June 13, 1994?
Q.Is there a lock on that door --
Q.-- that you can open with a key from the outside?
A.No, there's not.
Q.Is there an alarm and was there on June 13, 1994?
Q.Is there a key pad to activate the alarm there?
Q.Was there on the morning of June 13, 1994?
Q.Now, when you -- after you walked all the way around with the
detectives, did you enter the house?
A.Yes, I did. Now, what was the purpose of going into the house?
A.I was going into the house to go to get in touch with somebody that
could find out where my dad was.
Q.At that point, can you tell the jury whether or not you knew that
your father was out of town?
A.I knew he was out of town but I didn't know where he was.
Q.And who was it that you were going to contact to find out where he was?
A.I was going to call Cathy Randa.
Q.Who is Cathy Randa?
A.My father's personal secretary.
Q.Now, you --
Q. You had to -- tell us what you did as you entered the house -- before
A. I had to turn off the alarm and open the door with my key.
Arnelle lies. Yes that is exactly what Arnelle had to do and did do, when she entered her father's house. less than an hour before the police arrived. She turned the alarm off when she entered the house. But she never turned it back on when she exited the house using the back door, leaving it unlocked.

Q AND AFTER ARNELLE ASKED YOU THAT QUESTION, WHAT HAPPENED NEXT?
A THE -- MYSELF AND THE OTHER TWO DETECTIVES AND ARNELLE WALKED TOWARDS THE MAIN HOUSE.
Q NOW, DURING THAT TIME COULD YOU HEAR CONVERSATION IN KATO -- GOING ON IN KATO KAELIN'S ROOM WHILE YOU WERE TALKING TO ARNELLE?
Q WHEN YOU -- DID YOU WALK WITH ARNELLE SOMEWHERE AFTER YOU SPOKE TO HER?
Q AND WHERE DID YOU WALK?
A WALKED TO THE REAR OF THE MAIN HOUSE -- NOT TO THE REAR OF THE MAIN HOUSE, BUT THE BACK PORTION OF THE MAIN HOUSE WHERE THERE WAS SOME FRENCH DOORS AND ANOTHER SMALLER DOOR RIGHT NEXT TO IT.
Q WHEN YOU WALKED TOWARD THE MAIN HOUSE, DID YOU PASS BY MR.
Q DID YOU LOOK INSIDE?
A NO, I DIDN'T.
Q WHERE DID YOU GO?
A WALKED UP TO ONE -- ONE DOOR THAT LED INTO THE HOUSE AND ARNELLE SIMPSON UNLOCKED THE DOOR FOR US AND OPENED THE DOOR.
Q AND DID YOU ALL WALK INSIDE?
Q AND THAT WAS WHO AT THAT POINT?
A THAT WAS ARNELLE SIMPSON, MYSELF, TOM LANGE AND PHIL VANNATTER.
Q WENT IN THROUGH THE REAR?
Q AND WHERE DID YOU GO?
A WE WALKED IN THROUGH THE LIVING ROOM AREA AND THEN INTO A KITCHEN AREA AND FROM THE KITCHEN AREA WE WALKED AROUND TO A MAID'S QUARTERS THAT WAS OFF THE KITCHEN.
Q BY MS. CLARK: ALL RIGHT.
WHEN YOU ENTERED THE REAR OF THE HOUSE WITH MISS SIMPSON, WHAT
HAPPENED FIRST? WHAT WAS THE FIRST THING YOU DID?
A WE WALKED INTO THE KITCHEN AREA THROUGH THE LIVING ROOM AND WE WENT INTO THIS ROOM RIGHT OFF THE KITCHEN WHEN TURNED OUT TO BE A MAID'S ROOM.
Q WHY DID YOU DO THAT?
A WE WENT IN THERE TO SEE IF A MAID NAMED GIGI WAS IN THE RESIDENCE.
Q WHY YOU WERE LOOKING FOR GIGI?A BECAUSE WE HAD BEEN TOLD OUTSIDE THE RESIDENCE BEFORE WE EVER ENTERED IT THAT THERE WAS A FULL-TIME MAID THAT WAS SUPPOSED TO BE LIVING ON THE PREMISES AND ARNELLE HAD MADE REFERENCE TO GIGI WHEN WE WENT OUTSIDE THE RESIDENCE BEFORE EVER ENTERING.
Q WHAT WAS THAT COMMENT SHE MADE?
A SOMETHING TO THE EFFECT, "ISN'T GIGI IN THE HOUSE?" OR SOMETHING TO THAT NATURE.
Q SO YOU WERE LOOKING FOR GIGI?
Q WHY WERE YOU LOOKING FOR GIGI?
A WE HAD BEEN TOLD BY THE WESTEC PEOPLE THAT SHE WAS A FULL -- LIVE-IN MAID, FULL-TIME, AND ARNELLE HAD ALSO BROUGHT HER NAME UP, SO WE THOUGHT IF WE COULD FIND HER, SHE MAY KNOW WHERE MR. SIMPSON WAS AT IN THE HOUSE.
Q AND YOU WENT INTO HER ROOM THEN?
A WE JUST WENT INTO THE ROOM BRIEFLY, YES.
Q AND WHAT DID YOU SEE IN THE ROOM?
A THERE WAS NOBODY INSIDE THE ROOM AND THE BED WAS COMPLETELY
MADE AND THE ROOM WAS WELL ORGANIZED AND IT DIDN'T APPEAR THAT
ANYBODY HAD BEEN IN THERE RECENTLY.
Q THEN WHAT DID YOU DO?
A WALKED BACK OUT INTO THE KITCHEN.

Q AT THAT POINT, WHAT DID THE THREE OF YOU DO?
A I WAS STILL OUT IN THE -- ON THE WALKWAY. PHILLIPS PROCEEDED DOWN THE WALKWAY TO THE NEXT ROOM OVER AND I WAS BEHIND HIM, AND PHILLIPS HAD KNOCKED ON THAT DOOR AND A SHORT TIME LATER ARNELLE SIMPSON APPEARED.
Q NOW, DURING THAT TIME, DETECTIVE FUHRMAN WAS WHERE?
A HE WAS IN KAELIN'S ROOM.
Q AND WAS THERE A CONVERSATION THAT TOOK PLACE BETWEEN ARNELLE SIMPSON AND ONE OF THE DETECTIVES?
A YES. I BELIEVE INITIALLY WITH PHILLIPS AND THEN VANNATTER SHORTLY AFTER.
Q ALL RIGHT. NOW, AT THAT POINT, DID ARNELLE SIMPSON ASK YOU ANY QUESTIONS?
A YES. SHE WANTED TO KNOW WHAT WE WERE DOING THERE, IF THERE WAS ANY PROBLEMS. SHE SEEMED TO ME TO BE CONCERNED BECAUSE OF OUR PRESENCE.
Q OKAY. DID DETECTIVE VANNATTER ASK HER ANY QUESTIONS?
Q WHAT WAS THAT?
A ASKED IF HER FATHER, MR. SIMPSON, WAS INSIDE THE HOUSE.
Q AND WHAT WAS HER RESPONSE?
A SOMETHING TO THE EFFECT OF, "ISN'T HE HERE?"
Q SHE ASKED HIM, "ISN'T HE HERE"?
A YES. YES.
Q AND THEN WHAT HAPPENED NEXT?
A WE MOVED TOWARDS THE REAR AFTER ASKING ARNELLE IF SHE
HAD A KEY TO THE LOCATION. SHE SAID SHE DID. I BELIEVE SHE RETURNED TO HER ROOM BRIEFLY
AND GOT THE KEY AND CAME BACK OUT. WE THEN PROCEEDED TO THE REAR DOOR OF THE RESIDENCE
WHERE SHE UNLOCKED THE DOOR AND WE ENTERED.
Q BY MS. CLARK: ALL RIGHT. WHEN YOU GOT IN THE HOUSE WITH HER, DID YOU ASK A QUESTION OF HER?
A I ASKED IF THERE WAS A HOUSEKEEPER ON THE PREMISES.
Q WHY DID YOU ASK THAT?
A BECAUSE WE HAD INFORMATION THAT THERE WAS IN FACT A HOUSEKEEPER ON THE PREMISES OR SHOULD HAVE BEEN A HOUSEKEEPER ON THE PREMISES AND I WANTED TO KNOW.
Q WERE YOU CONCERNED FOR SOME REASON IN THAT REGARD?
A I WAS CONCERNED THAT THE HOUSEKEEPER MAY BE SOME TYPE OF A VICTIM. I DIDN'T KNOW. HOUSEKEEPER ON THE PREMISES?
Q WHAT HAPPENED NEXT WHEN YOU ASKED ARNELLE IF THERE WAS A
HOUSEKEEPER ON THE PREMISES?
A SHE STATED THAT SHE DIDN'T KNOW, BUT THAT THERE WAS A HOUSEKEEPER.
Q DID SHE SAY SHE DIDN'T KNOW IF THERE WAS A HOUSEKEEPER?
A SHE DIDN'T KNOW IF THERE WAS ONE ON THE PREMISES. I ASKED HER WHERE THE HOUSEKEEPER'S ROOM WOULD BE. SHE POINTED OUT A LOCATION TO THE REAR OF THE KITCHEN, AND AT SOME POINT, I PROCEEDED OVER THERE AND WALKED INTO THAT ROOM, THE ROOM THAT SHE STATED BELONGED TO THE HOUSEKEEPER.
Q DID YOU ASK TO SEE THE ROOM?
A I ASKED -- YES. I ASKED WHERE IT WAS.
Q AND WAS THAT THE FIRST ROOM THAT YOU WENT TO LOOK INTO
A NO. I WALKED THROUGH THE REAR AREA, THE I GUESS THE REAR DEN AREA AND THROUGH A FORMAL DINING ROOM AND THROUGH THE KITCHEN, OUT A SHORT HALLWAY, AND TO THE LEFT OF THAT WAS THE HOUSEMAID'S ROOM.
Q NOW, WAS ARNELLE LEADING YOU THROUGH THE HOUSE?
A SHE WAS WITH ME MORE OR LESS IN THE FRONT. INITIALLY WHEN I ASKED THE LOCATION OF THE HOUSEMAID ROOM, SHE MORE OR LESS WALKED IN FRONT OF ME AND POINTED OUT THE WAY.
Q DID YOU THEN IMMEDIATELY GO AND LOOK IN THE ROOM?
Q WHAT DID YOU SEE?
A THE BED WAS MADE. NOTHING LOOKED DISTURBED. NOTHING LOOKED OUT OF PLACE AND NO HOUSEMAID.
Q NO HOUSEMAID?
A THAT'S CORRECT.

Q WHAT HAPPENED NEXT?
A I ASKED MR. KAELIN IF HE WOULD COME WITH ME, AND WE EXITED HIS ROOM AND I LOOKED TOWARDS THE MAIN HOUSE AND I SAW THERE WAS AN OPEN DOOR, THE REAR OFF THE PATIO.
Q CAN YOU TELL US -- CAN YOU SHOW US, SIR, THE PATH THAT YOU TOOK ON THE DIAGRAM MARKED PEOPLE'S 66 IN THE COMPANY OF MR. KAELIN?
A YES. WE EXITED MR. KAELIN'S ROOM. WE WALKED UP THESE STAIRS, WENT TOWARDS THE MAIN HOUSE, PROBABLY THESE STAIRS RIGHT HERE. THERE'S A DOOR RIGHT HERE THAT WAS PARTIALLY OPEN (INDICATING). I BELIEVE IT HAD A SCREEN ON IT ALSO. WALKED INTO THAT DOOR. IT LED INTO A BAR AREA JUST TO THE LEFT OF A BILLIARD TABLE THAT YOU STEP DOWN INTO.
Q AND WERE THE OTHER -- WHERE WERE THE OTHER DETECTIVES?
A I DIDN'T KNOW. I HAD NOT SEEN THIS DOOR OPEN PRIOR. SO I ASSUMED THAT THEY WERE INSIDE THE RESIDENCE.
Q AND THE DOOR, WAS IT STANDING -- THAT REAR DOOR, WAS IT
OPEN WHEN YOU WENT IN WITH MR. KAELIN?
Q DID YOU ASK FOR HIS ASSISTANCE IN FIGURING OUT HOW TO GET INTO THE HOUSE OR WAS THAT OBVIOUS TO YOU?
A I MIGHT HAVE. BUT I NOTICED THE DOOR -- MR. KAELIN COULD HAVE -- COULD HAVE LED ME THERE. I'M NOT POSITIVE WHICH WAY THAT WENT.
Q SO YOU WALKED IN THROUGH THE REAR DOOR?
Q AND THAT WAS WITH MR. KAELIN?
Q AND WHAT DID HAPPEN NEXT AFTER YOU ENTERED THE HOUSE?
A WHEN I FIRST WALKED IN, I NOTICED THIS AREA, YOU STEP
THERE'S A LARGE BILLIARD TABLE AND THEN DIRECTLY IN FRONT OF WHERE WE CAME IN, THERE'S A BAR AREA WITH FOUR OR FIVE BAR STOOLS. AND I ASKED MR. KAELIN TO SIT IN ONE OF THOSE STOOLS AND RELAX AND SOMEBODY WOULD TALK TO HIM IN A MINUTE.

A I BELIEVE AS I RECALL EITHER ONE OF THE TWO, LANGE OR PHILLIPS,
KNOCKED ON THE DOOR. IT WAS PRETTY QUICKLY OPENED AND I HAD MOVED
UP BEHIND. I HEARD PHILLIPS ASK HER OR TELL HER, ASK HER IF SHE KNEW WHERE HER FATHER WAS, WE NEEDED TO GET IN TOUCH WITH HIM, WE HAD AN
EMERGENCY, AND SHE ANSWERED THAT QUESTION WITH ACTUALLY WHAT I
CONSIDERED A QUESTION OF HER OWN. SHE GESTURED TOWARD THE HOUSE
AND SAID, "ISN'T HE HERE," POINTING LIKE TOWARDS THE HOUSE.
AND I SAID TO HER AT THAT POINT, "I DON'T KNOW. IS HE? CAN WE -- CAN WE
GO INSIDE AND CHECK? WE NEED TO CHECK. DO YOU HAVE A KEY?" AND SHE
Q AND AT THAT POINT, DID SHE OBTAIN A KEY?
A YES. SHE OBTAINED A KEY FROM INSIDE THE ROOM AND LED US
WALKWAY TO THE REAR DOOR HERE (INDICATING).
Q NOW, DID SHE ENTER THROUGH THE REAR DOOR?
A THAT'S CORRECT.
Q AND DID SHE USE A KEY TO ENTER INTO THE REAR DOOR?
Q AND DID SHE ALLOW YOU ACCESS INSIDE THE HOUSE?
Q SHE NEVER OBJECTED?
Q BY MR. DARDEN: THANK YOU. DETECTIVE FUHRMAN DID NOT ENTER THE HOUSE ALONG WITH YOURSELF AND DETECTIVES LANGE AND PHILLIPS AND MISS SIMPSON?
A NO, HE DID NOT.
Q WHERE DID YOU GO ONCE YOU ENTERED THE HOUSE?
A I -- AS WE ENTERED THE HOUSE, I ASKED ARNELLE SIMPSON
MAID'S QUARTERS WERE. I WANTED TO CHECK AND MAKE SURE IF THERE WAS A MAID THERE IF SHE WAS OKAY. AND I WAS LED THROUGH A BAR AREA INTO A -- INTO THE KITCHEN AND THEN INTO A UTILITY ROOM AT THE SOUTH SIDE OF THE KITCHEN. SHE OPENED THE DOOR TO WHAT APPEARED TO BE THE MAID'S QUARTERS. I LOOKED IN AND EVERYTHING APPEARED TO BE IN ORDER.
Q OKAY. YOU SAY THAT YOU TOLD MISS SIMPSON THAT YOU WANTED TO LOOK INTO THE MAID'S QUARTERS TO SEE IF THE MAID WAS OKAY?
A I ASKED HER IF I COULD -- TO SHOW ME WHERE THE MAID'S QUARTERS WERE.
